NovellTale Terms of Service And User Agreement

Welcome to NovellTale. This Terms of Service and End-User License Agreement (“Agreement” or “Terms”) governs your access to and use of the NovellTale mobile application, website, content, and related services (collectively referred to as the “Services”). By installing, accessing, or using NovellTale, you agree to be bound by this Agreement, as well as our Privacy Policy. If you do not agree to these Terms, you must stop using the Services immediately and uninstall the NovellTale application.

NovellTale (“we,” “us,” or “our”) operates as a digital reading and storytelling platform that enables users to explore, read, and publish fictional works. These Terms set out your rights, obligations, and restrictions when using the Services. Please read them carefully before you begin.

1. Eligibility and Acceptance of Terms

You must be at least 13 years old, or the minimum age of digital consent in your country, to use NovellTale. Users under the age of 18 must obtain permission from a parent or legal guardian before using the Services. By using the Services, you affirm that you are capable of entering into a binding contract and that you comply with all applicable laws.

When you access or use NovellTale, create an account, or download our application, you acknowledge that you have read, understood, and accepted these Terms. NovellTale may modify or update these Terms at any time. Updates will be reflected by the “Last Updated” date above. Continued use after such modifications constitutes acceptance of the revised Agreement.

2. Account Registration and Security

To use certain features, such as saving your reading progress, publishing stories, or making purchases, you may need to register for a NovellTale account. You agree to provide accurate, current, and complete information during registration and to keep your credentials secure. You are responsible for all activity that occurs under your account.

You must not share your login credentials with others or use another person’s account without permission. If you believe your account has been compromised, you must notify us immediately at novelltale@outlook.com.

NovellTale reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or disrupt the platform’s integrity.

3. License Grant and Restrictions (EULA Section)

Subject to your compliance with these Terms, NovellTale grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the application on a personal device solely for personal, non-commercial entertainment purposes.

You may not:
– Copy, modify, or distribute the application or any content contained within it.
– Reverse engineer, decompile, or disassemble the app.
– Circumvent security features or access controls.
– Rent, lease, or sublicense the application to any third party.
– Use the app to develop a competing product or service.

All rights not expressly granted to you in this Agreement are reserved by NovellTale. Violation of these license restrictions may result in immediate termination of your access and potential legal action.

4. Ownership and Intellectual Property

All rights, title, and interest in and to the Services, including text, images, software, databases, design elements, graphics, and other materials, are owned by NovellTale or its licensors. The NovellTale name, logo, and other marks are trademarks of NovellTale and may not be used without written permission.

User-generated content remains the property of the creator; however, by posting or submitting content through NovellTale, you grant NovellTale a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, reproduce, distribute, publicly display, adapt, and promote such content in connection with the Services and for marketing purposes.

You represent that you own or have the necessary rights to all content you submit and that such content does not infringe on the rights of any third party. NovellTale is not liable for any user-generated content, and you agree to indemnify us for any claims arising from your submissions.

5. User Conduct and Prohibited Activities

You agree to use the Services in compliance with all applicable laws and not to engage in conduct that could harm others, disrupt the platform, or violate any law. This includes, but is not limited to, the following prohibitions:

– Posting content that is defamatory, obscene, sexually explicit, violent, hateful, or otherwise inappropriate.
– Uploading or transmitting malware, viruses, or any other malicious code.
– Impersonating another person, misrepresenting your identity, or falsely claiming affiliation with any individual or entity.
– Interfering with the operation of the Services or attempting to gain unauthorized access to our systems.
– Using bots, scrapers, or automated tools to collect data from the Services.
– Engaging in any activity that exploits minors or promotes harm or discrimination.

Violation of these rules may result in removal of your content, suspension or termination of your account, and possible legal consequences.

6. Virtual Items, Purchases, and Payments

NovellTale may offer users the option to purchase digital content, subscriptions, or in-app virtual items (“Virtual Items”). By making a purchase, you agree that all transactions are final and non-refundable except as required by applicable law.

Virtual Items have no monetary value and cannot be exchanged for real currency or transferred between accounts. NovellTale reserves the right to modify, suspend, or discontinue Virtual Items or payment features without notice.

Purchases may be processed through third-party payment providers (such as Apple, Google, or other app store platforms). You agree to comply with their respective payment terms and policies.

If you subscribe to premium content or recurring membership, you authorize automatic renewal and recurring billing until you cancel through your app store account settings.

7. Content Moderation and Removal

NovellTale strives to provide a safe, inclusive, and creative community. We reserve the right, but not the obligation, to monitor, review, or remove user content at our discretion.

We may remove or restrict access to any material that violates these Terms, applicable law, or community guidelines. We may also restrict or ban users who repeatedly post prohibited content or engage in abusive behavior.

If your content is removed, NovellTale has no obligation to restore it, and you may lose access to data or media stored within your account.

8. Privacy and Data Handling

Your privacy is important to us. NovellTale collects and processes personal data in accordance with its Privacy Policy, which forms part of this Agreement. By using the Services, you consent to the collection and use of your data as described therein.

NovellTale may collect usage data, device identifiers, and analytics information to improve the performance and personalization of the Services. We may also use cookies or similar technologies for functionality and advertising.

9. Third-Party Services and Links

The Services may include links or integrations to third-party websites, advertisements, or services not controlled by NovellTale. We do not endorse or assume responsibility for such third-party materials.

When you interact with third-party content, you do so at your own risk, and any relationship is governed by the terms and privacy policies of those providers.

10. Termination and Suspension

NovellTale reserves the right to suspend, restrict, or terminate your account or access to the Services at any time, with or without notice, if you violate these Terms, engage in illegal activity, or cause harm to others or the platform.

Upon termination, all rights granted to you under this Agreement will immediately cease, and you must uninstall the application. We are not responsible for the loss of any data or content associated with terminated accounts.

You may terminate your account at any time by deleting your account within the app or contacting us at novelltale@outlook.com.

11. Disclaimers of Warranties

The Services, including all content, materials, and functionality provided through NovellTale, are made available to you “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, NovellTale expressly disclaims all warranties, representations, and conditions, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

We make no guarantees that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. You understand and agree that your use of the Services is at your own discretion and risk. You are solely responsible for any damage to your device, data, or content that results from your use of the Services.

No oral or written advice or information obtained by you from NovellTale or through the Services shall create any warranty not expressly stated in this Agreement.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such cases, NovellTale’s warranties shall be limited to the minimum extent permitted by applicable law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, NovellTale, its affiliates, licensors, officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your access to or use of the Services. This includes, without limitation, damages for lost profits, data loss, goodwill, business interruption, device damage, or any other intangible loss, even if NovellTale has been advised of the possibility of such damages.

If, despite the limitations above, NovellTale is found liable for any loss or damage under any legal theory, the total aggregate liability shall not exceed the total amount you have paid, if any, for use of the Services during the six-month period immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow limitations on liability for personal injury or fraud, so some of these limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless NovellTale and its affiliates, officers, employees, agents, partners, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorneys’ fees) arising out of or relating to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) your User Content.

This defense and indemnification obligation will survive the termination of this Agreement and your use of the Services.

14. Updates, Modifications, and Changes to Services

NovellTale reserves the right to modify, suspend, or discontinue any aspect of the Services, including features, content, or pricing, at any time, with or without notice. We may also amend these Terms periodically to reflect changes in law, features, or company policies.

When changes are made, the “Last Updated” date will be revised. If changes are material, we will provide notice within the app or via email before the effective date. By continuing to use the Services after such changes take effect, you agree to be bound by the revised Terms.

If you do not agree to the updated Terms, you must discontinue use of the Services and delete your account.

15. Communications and Notifications

By using NovellTale, you agree that we may send you important notices, including service announcements and administrative messages, via email, push notifications, or within the application. You may choose to opt out of promotional communications, but you cannot opt out of essential service-related notifications.

Any legal notices required or permitted under this Agreement must be sent to novelltale@outlook.com. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

16. Governing Law

This Agreement and your use of the Services shall be governed by and construed in accordance with the laws of the jurisdiction where NovellTale is established, without regard to its conflict-of-law principles. You agree that any disputes or claims shall be submitted to the exclusive jurisdiction of the competent courts located in that jurisdiction.

If you reside in a country where local consumer protection or data protection laws provide additional rights, those rights will not be limited by this Agreement.

17. Dispute Resolution and Arbitration

In the event of a dispute, you agree to first contact NovellTale at novelltale@outlook.com to attempt to resolve the issue informally. Most disputes can be resolved without resorting to legal action.

If a resolution cannot be reached within 30 days, both parties agree to submit the dispute to binding arbitration under the applicable arbitration laws of the governing jurisdiction. The arbitration shall be confidential and conducted in English by a single arbitrator appointed under recognized arbitration rules.

The decision of the arbitrator shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. Each party shall bear its own costs, except where the arbitrator determines that a party’s claims were frivolous or brought in bad faith.

You agree that any dispute must be brought in your individual capacity and not as part of a class action or collective proceeding.

18. Export Control and Legal Compliance

You agree to comply with all applicable export and import laws and regulations when accessing or using the Services. You may not download, use, or export the application or any content in violation of applicable export laws, trade restrictions, or sanctions.

By using NovellTale, you represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist-supporting” country, and that you are not listed on any U.S. government restricted parties list.

19. Software Updates and Technical Support

NovellTale may, from time to time, issue software updates, patches, or upgrades to improve performance or security. These updates may be automatically installed without prior notice. You consent to the automatic download and installation of such updates as part of the continued use of the Services.

NovellTale provides technical support on a discretionary basis. We make no guarantees of response times, availability, or resolution outcomes.

20. Data Security and Account Protection

We implement reasonable security measures to protect your personal data and account from unauthorized access or disclosure. However, no system is entirely secure, and we cannot guarantee absolute protection. You are responsible for safeguarding your account credentials and device security.

If you suspect any unauthorized activity or breach, you must notify NovellTale immediately. We are not responsible for losses resulting from unauthorized access to your account caused by your failure to maintain proper security measures.

21. Termination by User

You may terminate your use of NovellTale at any time by deleting your account and uninstalling the application. Upon termination, your license to use the Services immediately ends. Some data may remain stored for legal, security, or backup purposes as permitted by applicable law.

All provisions of this Agreement which by their nature should survive termination shall remain in effect, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

22. Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under this Agreement without prior written consent from NovellTale. Any attempted assignment without such consent will be null and void. NovellTale may assign its rights and obligations under this Agreement to an affiliate or successor entity without restriction.

23. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a competent authority, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.

24. Waiver

The failure of NovellTale to enforce any right or provision under this Agreement shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of NovellTale to be effective.

25. Entire Agreement

This Agreement, together with the NovellTale Privacy Policy and any other supplemental terms or policies referenced herein, constitutes the entire agreement between you and NovellTale concerning your use of the Services. It supersedes all prior or contemporaneous communications, whether written or oral, related to the subject matter herein.

26. Children’s Use and Parental Responsibility

If you are a parent or guardian and allow your child to use NovellTale, you are responsible for monitoring their activity. NovellTale does not knowingly collect personal data from children under the minimum age of digital consent. If we learn that we have inadvertently collected such information, we will promptly delete it. Parents may contact us to request removal of a minor’s account.

27. Geographic Restrictions

NovellTale operates globally but may not be available in all regions or languages. Certain features or content may be limited or unavailable based on geographic location, applicable law, or licensing agreements. You are responsible for compliance with local laws when accessing the Services.

28. Force Majeure

NovellTale shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of nature, war, terrorism, labor disputes, governmental actions, network failures, or other events of force majeure.

30. Final Acknowledgment

By using NovellTale, you acknowledge that you have read and understood this Agreement, agree to be bound by its terms, and consent to the collection and processing of your data in accordance with our Privacy Policy. You also confirm that you are of legal age or have obtained the necessary consent to enter into this legally binding agreement.
